DOCUMENTS RE FEOFFEES OF ST. PETROX
IN
The following are copies of summaries made by Ray Freeman in the Devon
Record Office when researching for her books on the history of
The earliest
document found relating to the provision of water for the parish is dated
(in Latin) Henricus Quinto - i.e. Henry
V, who died in 1421. A typed translation
dating
from 1511 records the handing on of property to new Feoffees, and refers
back to an earlier transfer of 1485.
From these early dates it can be seen that successive feoffees looked after
much property in Southtown from the early 15C right up to the early 20C Documents
record how extra water supplies were added, and conduits repaired and
renewed. It is NOT TRUE (as stated on
the Bearscove conduit) that Dartmouth Corporation illegally seized the feoffees
property at the time of the Reformation - these documents prove that the
feoffees went on with their work through six centuries.
Nowhere however are
there papers showing the winding up the feoffees water supply system with the arrival of public water companies
- are these preserved somewhere else?

At end, date refers to Henricus Quinto, i.e. Henry V, died 1421.
No earlier document has so far been discovered.
2) 1163 F/L 1 1475 Similar charter to one below, of 1511, when John Yabbecombe
grants to John Carswell and others.
3) 1163 F/T 2 1511 Typed translation of charter dated 10/3/1511 saying that John
Fleming of Southtown grants to (names follow) all the lands in
Kingswear,Brixham and Southtown which he and (other names)
received on18/12/1485.
[The lands are not described, nor, in this transcript at
least, is there any mention of the purpose, e.g. water supply, but this
seems to be the pattern by which feoffees handed on the property to
the next generation of feoffees. ]
4) 1163 F/A 2 1600 George Southcote of Coffinswell, [now the new Lord of Stoke
Fleming and Southtown] for a consideration covenants with John Hawkins,
Walter Gunn [ more names] feoffees of the lands of St. Petrox ....
for the maintenance of waterpipes and conduits in Southtown that it will
be lawful for them and all other inhabitants of the Parish of St. Petrox
to
hold and enjoy the churchyard now newly enclosed on the west and
north side of St. Petrox.............and the paths leading to the said chapel
standing within the castle walls.

DOCUMENTS RE WHERE THE WATER CAME FROM:
1163 F/A 3 25/6/1781 Legal “case” in which Feoffees describe how the water rises in two
places:
1. Out of a rock near Blackman’s Well and cistern under or near house
built by Mr. Wm. Sharland, now inhabited by Mr. Brooking.
2. Out of rock above gardens near the stable built & occupied by
Mr. Dottin Channell where there is also a large cistern.
- from both places, it is piped “first low by the wall under the Church
path to St. Petrox, and the other down a lane on one side of which lyes
a garden occupied by Mr. Oxenham, & the other a garden belonging to
Charles Hayne Esq. The two pipes meet here, there being a cistern at
the bottom of this lane. From there water is carried by lead pipes into
two
public conduits on the

called Edems conduit near
Now Mrs. Holdsworth objects to paying an annual fee of 10/- for it.
1163 F/A 8 31/8/1835 Petition to Feoffees by 27 parishioners that:
“The conduit now standing in the Passage Slip be removed to the
corner of Mr. Lamzed’s house.”
Names of petitioners include Peek, R.L.Hingston, Thos. Lidstone Jr.,
Brooking, Stapledon, A.B.Harris, Ed. Bastard, Geo. Lamzed.
1163 F/T ? 22/1/1836 Grant of Water in Coombe Meadow by A.H.
Holdsworth.
A. H. Holdsworth grants to feoffees for considn. of 5/- for term of
2,000 years the right to take water from the
watercourse in Coombe Meadow, situate in Parish of Stoke Fleming,
now occupied by Edm. Toll, flowing & leading to certain mills of
A.H. Holdsworth at Warfleet near the said meadows .......so much
water as will run .....through a pipe of 1” diameter from a cistern to be
inserted in Coombe meadow.......at the expense of the Feoffees .... to a
pipe

Southtown ... to be joined to other public conduits erected or to be
erected in Southtown.

WHEREAS Jn. Hy. Seale owns on term of 99 years Coombe Meadow
in Stoke Feming parish, now occupied by Edm. Toll AND ANOTHER
MEADOW ADJOINING same on North, now occupied by Richard
Buckpitt, which sd. meadows were recently purchased from Harriet
Southcote, spinster, by Jn. Hy. Seale & were owned by her ancestors
for long years past,
NOW Jn. Hy Seale grants to the Feoffees of St. Petrox the right to
take water flowing from them .....to make cisterns, lay pipes .... for the
purpose of conveying water to Southtown for the benefit of its
inhabitants.

1163 F/T 11 29/7/1897 Letter from Veale to Hockin objecting to provision in proposed
agreement saying that Trustees cannow allow water to be used for
building. He complains Council is misinformed as to water in conduit
being used by him to detriment of public. He is one of the public
himself and entitled to use it for building as long as no one else is
deprived of it. The water daily overflows into the sewer - he saw this
happen
by Wm. Pillar’s house in
his water supply from another source.
P.S. For years the Manor House was supplied from “your reversion”
without the Charity’s knowledge.
