Will of Mark Fox Esq of Summerland Villa, Dartmouth.  Examined with probate 18 March 1911, death 13 June 1893.

Mark Fox of Summerland Dartmouth appoints nephews Mark Whittle of Dartmouth and Charles Henry Fox of Manchester executors. I'd give my broadwood piano to my great niece Beatrice Jones daughter of George Jones of Dartmouth shoemaker. Gives Gold watch and chain and appendages to nephew Mark Whittle of a New Road Dartmouth. Gives to Annie Austin wife or reputed wife now living with me the use of all Silver and furniture for her life or until she marries.

Executors to make an inventory of all goods, his wife to signed. After her death or marriage these are to become part of his residuary estate and distributed accordingly. Wants least possible amount spent on funeral, no morning or coaches. Give to my executors all my real-estate which they may realise by selling or letting, on trust (1) to pay £25 annually in quarterly instalments to old servant Elizabeth Baker for her lifetime, to cease on death of Annie Austin. (2) they are to pay £20 annually to brother James Fox during his life, after his death the same annuity to be paid to nephew Frederic Henry Whittle, during his life or up till death of Annie Austin. (3) Mark Whittle is to retain for himself £5 per annum for his trouble until this estate is wound up after providing the annuities.

 

My trustees to pay remainder of income from estate to Annie Austin for her own use so long as it's she remains unmarried. After which ever of these happens first the two annuities above to cease but one to brother James it to continue for his life, and £5 to Mark Whittle. Trustees after paying expenses to divide net proceeds as follows. To Frederick Henry Whittle, nephew, if alive, £300 in lieu of the annuity of £20, and £200 to Elizabeth Baker instead of her annuity of £25. The balance to be divided into equal shares between my other nephews living at his death and niece Kelurah? Jones, wife of George Jones, if she has died George Jones absolutely.
