Recites that Edmund Pearce Banfill in his will of 8.12.1799 left his property under trustees William Newman and John Christophers to his daughter Mary Ann Gibbs wife of Martin Price Gibbs, for her sole separate use, independent of her husband. E.P.Banfill died on 1.4.1802. On 4.6.1802 after a public survey, Martin P. Gibbs, highest bidder, bought property for £200. William Newman in 1805 renounced to John Christophers his rights as a trustee. Now Mary A. Gibbs pays £200, being her share of the estate of her late father, to John Christophers and in consideration of ten shillings paid by Martin P.Gibbs and Clement Banfill (being in their actual possession) to John Christopher and of five shillings for one year -
DESCRIPTION: Messuage and garden lying at Hardness (some time since built by Edmund Pearce Banfill on the north end and on part of the sd. garden) bounded by –
the king’s highway on the north
the lands of the parish of Townstal on the east
the lands formerly of William Voysey on the south
and the lands of (left blank) on the west
which garden was formerly the lands of William Voysey, afterwards of William Colesworthy, since of Henry Land, late of Thomas Falaise of whom Edmund P. Banfill purchased it.

Bequeaths the house in which she now resides, which is in trust for her, and also sums of money and personal estate, to her husband Martin Price Gibbs for his life, and afterwards to their children equally divided as her husband shall by his last will bequeathe.

Conveys parcel of ground described in first abstracted indenture from Silly to Gibbs.
Memorandum that on date of indenture full possession of the premises was delivered to Martin P. Gibbs in presence of Nicholas Brooking Junior and John Elliott Fox (attorneys).

The sd. Mary Ann Gibbs died on 4.1.1848 leaving only two surviving children,
i.e. Mary Ann wife of Mr. Robert Hayne and Susan wife of Mr. Cllement Banfill

CONDITIONS ON THE SALE of freehold messuage & garden now in possession of William Kelly. Conditions on the sale:
1. Vendors may put property up for sale entire or in lots.
2. Purchaser shall sign memorandum of purchase subject to these conditions for payment of purchase money at offices of Nicholas Brooking, solicitor, Dmth, on 2nd September next (? 1851) after which he will be let into the property.
3. Vendor shall at his expense prepare an Abstract of Title, going back thirty years will be considered sufficient.
4. That title shall commence with the Indenture of Feoffment dated 15.2.1806. As Martin P. Gibbs died abroad soon after making his will of 1820 and it was not proved, purchaser will be satisfied with the delivery of the original will and accept it as a valid document.
5. If a valid objection can be made to the title within one fortnight of delivery of the Abstract ........the vendor’s solicitor can rescind the contract but if no objection is made the title shall be deemed accepted.
6. On payment of residue of purchase money vendors shall sign conveyances. All covenents etc. which the purchaser may require to paid for by him.
7. That all title deds relating solely to the property shall be delivered to the purchaser but such as may relate to two lots jointly shall be retained by the Vendors who shall covenant to produce and deliver copies thereof in the usual way.
8. That the properties be taken as they actually are and without reference to the description in the Advertisement, and subject to any chief or quit rents payable thereon and with all other outgoings needful by the Auctioneer.
9. If the purchaser neglects to comply with any of the above conditions his Deposit money shall be forfeit.

CONTINUATION OF MR. BAMFILL’S ABSTRACT OF TITLE.
22/4/1848 By Indenture between 1. Clement Tessier Bamfill of Newton Abbot, Grocer
and Susan his wife.
and 2. Robert Rendell of same place, Auctioneer.
Reciting that Martin P. Gibbs, father of Susan Bamfill, at time of his death and last will possessed of the houses and premises later described. He died on 15.3.1824 leaving his possessions to his wife and after her death equally between their children. When he died only two children were still surviving. As stated in his will, his wife remained in possession of the house until her death on 3.1. ‘last past’ [?1848].
At the time of her death the two heiresses were Mary Ann Mayne and Susan Bamfill, both daughters of Martin Gibbs and his wife Mary Ann. By the will of Mary Ann Gibbs Susan Bamfill was entitled to one half part of the estate.
Susan and Clement T. Banfill by this deed, in order to make this property absolutely at their disposal, desired, for the nominal consideration paid by them to Robert Rendell, according to the Statute for the abolition of Fines and Recoveries, did each of them grant to Robert Rendell:
Description: All that one equal undivided moiety or half part of ..... that parcel of ground being in the parish of Townstall ......formerly in possession of Thomas Silly, his tenant or tenants, then used as garden ground, bounded by –
- on the south sides by the lands of William Teague (sic) deceased,
- on the east side by lands formerly of Edmund Bamfill
- on the north side by the Ridgway
and of all those TWO dwelling houses.......sometime since erected .....all which were lately in possession of Martin A. Gibbs or his tenants.
R. Rendell to hold said premises in trust for Susan Bamfill...... for 80 years.....if she should so long live........to collect the rents for the premises for Susan Bamfill

Whereas Martin Price Gibbs, by his will of 1820 (See above) bequeathed his property to his wife Mary Ann Gibbs and after her to their surviving children, and died soon after without making another will, and Mary Ann Gibbs died on 4.1.1848, leaving only two of her children surviving, namely Mary Ann wife of Pete Mayne, since deceased, and Susan Banfill wife of Clement Tessier Banfill, whom she married on 18.4.1848 and who on 22.4.1848 by auction for a nominal consideration purchased ONE HALF PART of ground, house & garden;
AND whereas by indenture of 15.2.1848 between Robert Mayne, Mary Ann Mayne his wife and John Beachey in consideration of £100 paid to Robert Mayne by John Beachey and for nomminal consideration to Mary Ann Mayne, ONE HALF PART , being Mary Ann Mayne’s share of the house & garden were conveyed to John Beachey upon trust for Robert Mayne & Mary Ann Mayne [a mortgage] and whereas the principal and interest on this mortgage have been paid, And whereas Mary Ann Mayne died on 26.3.1848 and her husband also died and was buried in Wolborough about 13.4.1848, leaving his son Thomas Mayne the eldest son of their marriage, which was celebrated at Kingskerswell on 16.10.1828 and Thomas Mayne baptized at Wolborough on 11.9.1829,
AND whereas on 21.10 ‘last’ John Beachey paid £50 to Thomas Mayne for one undivided half part of the premises described which with interest @ 5% came to £70, and whereas the sum of £60 is now due to Thomas Payne from John Beachey, and has been paid,
And whereas William Kelly has agreed with Susan Banfill and Thomas Mayne for for the absolute purchase of the house, garden etc. later described for £160 out of which it has been agreed to pay £60 to John Beachey,
NOW this indenture witnesseth that in consideration of £80 pd. by William Kelly to Susan Bamfill , she directs that ALL THAT her half ......................upon trust and with the intent concerning the other half of the premises to be conveyed
AND in consideration of £60 paid by William Kelly to John Beachey by the direction of Thomas Mayne owing upon the mortgage of 21.5. last, receipt of which is acknowledged,
......conveys to William Kelly one undivided half part being Thomas Mayne’s messuage dwelling house and garden on the Ridgway in parish of Townstal and now in the occupation of John Haine as servant thereof........................
BACK OF INDENTURE summarises what was received from whom:
1. Received ...from William Kelly the sum of £80 the full consideration money -- signed Susan Banfill.
2. Received .. from William Kelly the sum of £60, the full consideration money - J. Beachey.
3. Received .. from William Kelly the sum of £20 which with the sum of £60 paid as above make together the sum of £80 my full consideration money - Thomas Mayne.

Recites that Mary A. Mayne was seized in fee simple of one undivided half part of
premises later described, as one of two surviving children of Martin P. Gibbs and his
wife Mary Ann, according to Gibbs’ will of 1820.
Recites that Robert Mayne took a mortgage from John Beachey of £100, on security of
premises at Ridgway .........discharged from her dower. They may dispose of same provided they pay the interest @ 5% and refund the capital of the £100.
15.2.1848 Recites that J. Beachey has received in full the principal and interest due.
Recites that Mary Ann Mayne died in the life time of her husband and was buried in the
21.5.1851 INDENTURE between 1. Thomas Mayne, late of N. Abbot then of
Vauxhall,
Recites that T. Mayne was then possessed in fee simple of one half part of the premises,
later to be described, to be conveyed. He requested a mortgage from J. Beachey, basd on security of these premises. His intention was to sell it. Interest charged at rate of 5% .
All agreed.

Description: All that dwelling house now in ruins known as the “American House” with the garden attached formerly the property of Mrs Mary Ann Gibbs deceased ...then described as situate in Hardness in parish of Townstall, now better known as situate in Ridge Hill........ bounded by:
- said hill or highway on north
- lands of feoffees of parish of Townstall on east
- lands of Sir Henry Paul Seale, Bart, formerly of Voysey, on south
- lands formerly Gibbs late Kelly and now of Augusta Hockin on west
All above conveyed to Augusta C. Hockin.
ABSTRACT OF TITLE to above premises [see 28.9.1863] by Gibbs, Mayne & Banfill.
[Traces ownership of land back to deed of 1810, when land left in his will by Edmund Pearce Banfill was conveyed in trust to daughter Mary Ann, wife of Martin P. Gibbs. This abstract shows the descent of Gibbs, Mayne and Banfill from Mary Ann Gibbs and Martin Price Gibbs.]
Recites will of Mary Ann Gibbs leaving her personal estate shared equally between her surviving children from her marriage to Martin P. Gibbs, who died in 1824 many years before her.
Lists her surviving children: Mary Ann married Robert Mayne.
Susan married Clement Banfil.
Martin Price Gibbs survived his father, but died at sea during his mother’s lifetime, leaving by Jane his wife one one son Martin being one of present vendors.
Mary Ann Mayne and her husband are both dead, leaving Thomas their eldest son and heir.
Susan and Clement Banfil are both dead, leaving a son and other children.
CONCLUSION: Property vested either wholly in Mrs Mayne
& Mrs
to them and 4/8 to heir at law of Martin P. Gibbs.

Whereas N. L. D. Teage is seized of two equal third parts of land hereafter described
and Mary Newman is seized of the remaining third part, they agree to sell the land to

Whereas Thomas Lidstone of Dmth, Architect, died seized in fee simple of property hereafter described, in his will of 31.12.1887 left this to his wife Martha Ann by the description “the yard in Clarence Street opposite to his present dwelling house and then in his own occuption.” Thomas Lidstone died on 28.6.1888, his will being proved.

17.10.1885 WILL of CHARLES HUTCHINGS HAZARD
Appoints wife Susanna Potter Hazard and her son Edward Wenman Martin trustees. Gives
wife all household goods in his dwelling house at Ridge Hill, and as to house in Clarence
St. trustees to allow wife to receive the clear yearly income during her lifetime, after her decease both houses to pass to Edward Wenman Martin. (Other bequests to relatives.)
